Welcome to Zaeline. By accessing or using our website and services, you confirm that you have read, understood and agree to these Terms and Conditions. If you do not agree to these terms, we ask that you do not use our website or services.
1. Definitions
The following terms are used in these Terms and Conditions:
- "Zaeline" — the owner and operator of the online store and website, reachable at info@zaeline.com.
- "Customer" or "you" — any individual who uses the website or places an order.
- "Services" — the website, online store and all related features, tools and content offered by Zaeline.
- "Agreement" — the purchase agreement established between Zaeline and the customer upon placing an order.
- "Product" — any item offered for sale through the Services.
2. Applicability
These Terms and Conditions apply to all offers, orders and agreements between Zaeline and the customer. By placing an order, you confirm that you have read and agree to these terms. Zaeline reserves the right to amend these terms at any time. Changes will be published on the website and will apply to all orders placed after the publication date.
3. Offers and Formation of Agreement
All product offers on the website are non-binding and subject to availability. An agreement is formed at the moment Zaeline has sent an order confirmation by email to the email address provided by the customer. Zaeline reserves the right to refuse or cancel an order, for example in the event of stock depletion, pricing errors, fraud or other valid reasons. In such cases, the customer will be informed as soon as possible and any amount paid will be fully refunded.
4. Prices and Payment
All prices on the website are listed in euros (€) and include VAT, unless otherwise stated. Shipping costs are not included in the product price and are displayed separately at checkout. Zaeline reserves the right to change prices at any time. The price applicable at the time of ordering is the final price for that order. Payment must be made via the available payment methods on the website. Orders are only processed upon receipt of full payment. In the event of non-payment or a chargeback, Zaeline reserves the right to cancel the order and take further action.
5. Delivery
Zaeline aims to process and ship orders as quickly as possible. Delivery times are indicative and depend on the product. Some products may require up to 30 calendar days to be delivered. Zaeline is not liable for delays resulting from circumstances beyond its control, such as customs procedures, weather conditions or carrier delays. 6. Right of Withdrawal and Return Policy
As a consumer in the European Economic Area, you generally have the right to withdraw from a distance agreement within 14 calendar days of receiving the product, without giving a reason. However, this right of withdrawal is excluded for the following categories of products:
- Opened beauty and personal care products whose seal has been broken, for health or hygiene reasons.
- Consumables that have been opened or used.
- Personalized or custom-made products.
- Digital products that have already been downloaded or opened.
For all other returns, the conditions described in our Return and Refund Policy apply, which forms an integral part of these Terms and Conditions. This includes, among other things, a 40% restocking fee and return shipping costs at the customer's expense. By placing an order, you confirm that you have taken note of and agree to these conditions.
7. Warranty and Conformity
Zaeline guarantees that the delivered products meet the description on the website and are free from manufacturing defects upon delivery. If a product appears to be defective or damaged upon receipt, the customer must report this within 7 days of receipt via info@zaeline.com, accompanied by photos or videos of the defect. In that case, Zaeline offers replacement of the product or store credit to the value of the item. Cash refunds are not offered for defective items. The warranty does not apply to damage caused by improper use, normal wear and tear or external factors.
8. Liability
Zaeline is not liable for indirect damage, consequential damage, loss of profit or other damage arising from the use of the Services or the delivered products, to the extent permitted by applicable law. Zaeline's total liability is in all cases limited to the amount the customer has paid for the relevant product. Zaeline is not liable for damage resulting from improper use of products, force majeure, or failure to follow usage instructions.
9. Intellectual Property
All content on the Zaeline website, including but not limited to texts, images, logos, product descriptions and graphic material, is the property of Zaeline or its licensors and is protected by copyright and other intellectual property rights. It is not permitted to copy, reproduce, distribute or otherwise use content from the website without prior written permission from Zaeline.
10. Use of the Website
You agree to use the website solely for lawful purposes and in a manner that does not infringe the rights of others. The following are not permitted:
- Using the website for fraudulent or illegal activities.
- Providing false or misleading information when placing an order.
- Disrupting or damaging the operation of the website.
- Gaining unauthorized access to Zaeline's systems or data.
Zaeline reserves the right to refuse or terminate access to the website for users who violate these terms.
11. Chargebacks and Payment Disputes
By placing an order with Zaeline, you confirm that you have taken note of and agree to all applicable policies, including the Return and Refund Policy and the Shipping Policy. In the event of a dispute, we ask that you first contact our customer service at info@zaeline.com so that we can resolve the issue. Initiating a chargeback without prior contact with Zaeline is considered a violation of these terms. Zaeline reserves the right to submit all relevant documentation, correspondence and policies in payment disputes to protect its rights.
12. Privacy
Zaeline processes personal data in accordance with applicable privacy legislation and our Privacy Policy, which forms an integral part of these Terms and Conditions. By using the Services, you agree to the processing of your personal data as described in the Privacy Policy.
13. Force Majeure
Zaeline is not obliged to fulfil any obligation if it is prevented from doing so as a result of force majeure. Force majeure means any circumstance beyond Zaeline's control, including but not limited to natural disasters, war, pandemics, strikes, government measures, disruptions to telecommunications or transport networks, and failures of suppliers or carriers.
14. Applicable Law and Dispute Resolution
These Terms and Conditions and all agreements between Zaeline and the customer are governed by applicable law. Disputes arising from or related to these terms or an agreement will first be resolved amicably. If this is not possible, the dispute may be submitted to the competent court. As a consumer, you also have the option of using the European ODR platform for online dispute resolution, accessible at ec.europa.eu/consumers/odr.
15. Amendments
Zaeline reserves the right to amend these Terms and Conditions at any time. Amended terms will be published on the website with the date of the last amendment. Continued use of the Services after publication of amended terms constitutes acceptance of those amendments.
